Probate
Probate is the formal act of administering the Estate in a court proceeding. An Executor or Administrator is appointed and is issued Letters of Office from the court in order to administer the assets of the Estate.
NonProbate
It is not always necessary or legally required to probate an Estate in court. The small estate administration process involves locating the assets of the estate and providing the small estate administration tools that allow these assets to be administered without going through a court proceeding.
Trust Administration
A trust can be created and funded during the Decedent's lifetime or in Decedent's Will that is funded upon the Decedent's passing. This trust usually states what is to happen to all of the assets inside of the Decedent's Trust and appoints a Trustee to administer the assets of the Trust.
